Track Club Conditions of Entry and Participation
Application and acceptance
1. The following conditions of entry (Conditions of Entry and Participation) apply to each person who registers for, is issued a ticket or bib for, or participates in the running event known as Track Club and conducted by Supercars (Track Club).
2. In these Conditions of Entry and Participation:
a. Supercars means V8 Supercars Australia Pty Ltd of Level 34, Suite 2, 100 Miller Street, North Sydney NSW 2060 and its related bodies corporate (Supercars);
b. Event means Track Club and all activities associated with it, including registration, bib collection, access to the course, participation in the run, and the post-run experience;
c. Participant means the person registered for, issued a ticket or bib for, or participates in the Event; and
d. Ticket includes any ticket, pass, credential, bib, timing device or other entry authorisation issued for the Event.
3. By completing the registration process, accepting these Conditions electronically, collecting a bib or participating in the Event, you acknowledge that you have read, understood and agree to be bound by these Conditions of Entry and Participation.
4. For a Participant under 18 years of age, a parent or legal guardian must accept these Conditions of Entry and Participation for and on behalf of the Participant, consent to the Participant taking part in the Event and ensure the Participant complies with them. References to "you" include the Participant and, where applicable, the parent or legal guardian accepting these Conditions of Entry and Participation.
5. These Conditions of Entry and Participation apply in addition to the general conditions of entry for the Gold Coast 500 and any rules, safety information, participant guide or reasonable directions published or issued by Supercars.
Tickets
6. A Participant aged 16 (or another age as specified at the point of sale for a Ticket) and over at the time of entry to an Event must only attend the Event using an adult Ticket.
7. A Participant aged 15 (or another age as specified at the point of sale for a Ticket) and under at the time of entry into the Event may enter the Event using a Kids Ticket and must be accompanied by a parent or guardian aged 18 years or over who holds an adult Ticket.
8. Supercars may require evidence of a Participant's age or make a reasonable assessment of age, in which case that assessment will be final and determinative.
9. A Participant aged 15 years or under must remain under the care and supervision of their accompanying parent or guardian before, during and after the Event and may only participate in a category or wave designated by Supercars for kids.
10. Tickets are personal to the registered Participant and must not be transferred, resold, offered as part of a promotion or used by another person without Supercars' prior written consent.
Bib collection and participant identification
11. The Participant must collect their bib and any timing device from the location and within the collection times published by Supercars, and present any registration confirmation or identification reasonably requested by Supercars. Failure to collect a bib by the applicable cut-off time as published by Supercars may result in the Participant being refused entry without refund, except where required by law.
12. The Participant must wear the bib and any timing device in the manner directed by Supercars, and must not alter, obscure, duplicate or transfer them. Supercars may refuse access to the course if the Participant cannot produce a valid Ticket or correctly worn bib, or if the bib or timing device is lost, damaged, altered or registered to another person.
Fitness and responsibility to participate safely
13. Participation involves physical exertion. The Participant is responsible for determining whether they are physically and medically fit, adequately prepared and capable of participating safely without causing harm to themselves or others.
14. By participating, the Participant confirms that they have taken reasonable steps to assess their fitness, that to the best of their knowledge they are fit to participate, and that they are not aware of any medical or other circumstance that would make participation unsafe.
15. The Participant is responsible for carrying any medication or medical device they may reasonably require and for providing accurate emergency contact and relevant medical information during registration.
16. The Participant must not start, or must immediately stop, if they become injured, unwell, disoriented or unable to continue safely, or if directed to do so by Event staff or medical personnel.
Course Rules, Conduct and Safety
17. You must abide by all directions given to you by Supercars and/or Event staff, police, Event security or any person appointed as an authorised person under any relevant legislation or instrument.
18. The Participant must:
a. start in the allocated wave and comply with all applicable wave, pace and cut-off requirements;
b. remain on the marked course and follow all directions of Supercars, Event staff, course marshals, security, police, traffic controllers, medical personnel and emergency services;
c. exercise reasonable care for their own safety and the safety of others, including by not pushing, obstructing or acting unpredictably;
d. give way to Event, safety, medical and course vehicles and keep clear of restricted areas;
e. wear suitable clothing and footwear appropriate to the conditions; and
f. immediately report any hazard, injury or incident to Event staff.
19. Unless expressly permitted by Supercars, Participants must not:
a. conduct themselves in a manner which brings Supercars or an Event into disrepute;
b. use or bring onto the course prams, wheelchairs, animals other than assistance animals, or any item that may create a hazard, unless permitted for a designated category;
c. do anything or conduct themselves in a way which, or which has the potential to;
i. disrupt, hinder or interrupt the Event or any activity taking place at the Event;
ii. unreasonably disrupt, interrupt, interfere with or obstruct any Supercars staff, Event staff, police and/or Event security;
iii. adversely affect the safety of Event attendees, Supercars staff and/or Event staff;
iv. interfere with the comfort and enjoyment of the Event by Event attendees;
v. damage or deface any part of the Event venue or any other person's property;
vi. use racist, indecent or obscene language or threatening or insulting words or otherwise behave in a threatening, abusive, riotous, indecent or insulting manner;
vii. enter any restricted area;
viii. carry out any commercial or political activity within an Event, including offering goods or services for sale;
ix. conduct surveys or opinion polls;
x. post, place, erect or otherwise distribute any advertising or promotional material;
xi. litter;
xii. smoke or vape anywhere except in areas where smoking is permitted as designated by Supercars;
xiii. engage in ambush marketing; or
xiv. engage in any criminal activity.
20. Supercars reserves the right to refuse you entry to, remove you from an Event, cancel or confiscate your Ticket, or take any other action which Supercars considers appropriate if:
a. you are in breach of these Conditions of Entry and Participation;
b. you provide false or incomplete information;
c. you fail to meet a cut-off time;
d. you are in breach of any applicable law and/or government regulation;
e. Supercars receives a direction to do so from law enforcement agencies; or
f. Supercars reasonably believes that your conduct negatively impacts, or has the potential to negatively impact the safety, security or comfort of other patrons, staff or participants, or the integrity of Supercars or motorsport in general.
21. You acknowledge that you are responsible for the safety and security of your own personal property, including property left at a bib collection point, bag drop, start or finish area, and to the extent permitted by law, hereby release Supercars from any liability for loss of, theft of, or damage to (including any direct, indirect or consequential loss or damage) any personal property brought into any area of the Event.
22. You acknowledge that the Event takes place outdoors and your attendance may result in you being exposed to direct sunlight and heat. You are responsible for taking appropriate care for your own wellbeing at the Event including but not limited to hydration and sun protection.
Event scheduling, changes and cancellation
23. Any timings, scheduling, distances, lap numbers, routes, course features and entertainment published or otherwise released by Supercars for Track Club or other activities proposed to take place at Track Club (Scheduling) are provisional and subject to change.
24. Supercars may delay, suspend, postpone, relocate or cancel the Event due to severe weather, unsafe conditions, public health risks, pandemic, epidemic, quarantine, fire, flood, smoke, terrorism, civil disturbance, industrial action, venue or circuit unavailability, government or emergency service direction, change in law, or any other event beyond Supercars' reasonable control (Force Majeure Event). To the extent permitted by law, Supercars will have no liability for any loss or damage arising from the delay, suspension, postponement, relocation or cancellation of the Event due to a Force Majeure Event.
25. If the Event is postponed or proceeds in a modified form, no refund, credit or other compensation is payable solely because of that modification, except where required by law.
26. If the Event is cancelled due to a Force Majeure Event, no refund, credit or other compensation is payable, except where required by law.
27. Supercars makes no representations or warranties that any particular performer or other personality, activity or other entertainment will perform or otherwise appear at the Event.
Photography and recordings
28. Unless authorised or instructed by Supercars, you must not make any sound recordings, record any vision (Recordings), or take any photographic images at the Event for a commercial purpose.
29. You hereby assign to Supercars all copyright and other intellectual property in any Recordings you make or photographic image you take at the Event without the instruction or authorisation of Supercars.
30. You acknowledge that Supercars and third parties authorised by Supercars may make Recordings or take photographic images at the Event which feature you or your likeness. You hereby grant Supercars and such third parties a perpetual, irrevocable, royalty-free, worldwide, transferable and sub-licensable right and licence to use such Recordings, images and race results in any media and for any purpose without compensation or payment of any kind to you or the need to personally attribute you.
Medical Treatment
31. The Participant authorises Supercars, Event medical providers and emergency services personnel to provide or arrange first aid, medical treatment, transport, evacuation or hospitalisation that they reasonably consider necessary in connection with the Event.
32. To the extent permitted by law, the Participant is responsible for costs associated with treatment or transport that are not covered by Medicare, private health insurance or any insurance maintained for the Event.
Warranties and liability
33. You acknowledge that you enter the Event at your own risk. Subject to clause 34 of these Conditions of Entry and Participation and to the extent permitted by law:
a. you release and indemnify Supercars against any loss, liability, damage, cost or expense whatsoever and howsoever arising (whether direct or indirect) resulting from, or in connection with, any claim threatened or made, or action brought against Supercars in respect of, or in connection with, your attendance at or participation in the Event and Supercars will not be liable to you in any way for such loss, liability, damage, cost or expense; and
b. to the extent permitted by law, no condition, warranty, right or liability, whether express or implied, applies to these Conditions of Entry and Participation, other than those conditions, warranties, rights and liabilities expressly set out in these Conditions of Entry and Participation,
(together, the Modification of Rights).
34. No Modification of Rights will operate to the extent such modification would exclude, restrict or modify any condition, warranty, right or liability, including any liability under the Competition and Consumer Act 2010 (Cth) (the ACL), in a manner which would render these Conditions of Entry and Participation or any provision of these Conditions of Entry and Participation void, illegal or unenforceable.
35. To the extent permitted by law, the total liability of Supercars to you in relation to a breach of a statutory guarantee under the ACL will be limited in the manner set out in schedule 2, sections 64A(1) and 64A(2) of the ACL.
36. For the purposes of section 139A of the ACL, you acknowledge and agree:
a. your attendance at the Event is for the purposes of your own recreation, enjoyment or leisure;
b. your participation in any Recreational Activities (as defined in section 139A of the ACL) at the Event puts you at significant risk of physical or mental injury (including the acceleration or aggravation of any injury, disease or condition) or even death from a number of factors inherent in the Recreational Activities, including but not limited to trips and falls, uneven or slippery surfaces, dehydration, heat exhaustion, heat stroke, cardiac events, muscle or skeletal injury, collision with other participants, heavy machinery, the emission of noxious fumes and/or loud noises, weather conditions and the conduct of other participants;
c. you are responsible for assessing your own fitness to participate in the Recreational Activities and must seek medical advice if you are uncertain of such fitness;
d. you voluntarily attend the Event and participate in any Recreational Activities at the Event at your own risk despite knowledge of the risks outlined above; and
e. to the extent permitted by law, Supercars excludes all liability to you for any loss or claim suffered by you in relation to any death or physical or mental injury (including the acceleration or aggravation of any such injury, disease or condition) which arises from or in connection with your or anyone else's participation in any Recreational Activities as a result of a breach by any Associated Entity of the guarantees under schedule 2, sections 60, 61 or 62 of the ACL (Recreational Activity Exclusion).
Privacy
37. Supercars may collect personal information (within the meaning of the Privacy Act 1988 (Cth)) about you which is necessary for it to operate the Event and to help promote the Event and subsequent Supercars events. You consent to the collection, storage, use and disclosure of your personal information in accordance with Supercars' Privacy Policy (www.supercars.com/privacy-policy), which contains information about how you may access and seek correction of your personal information, how you can complain about a breach of your privacy rights, and how a complaint will be dealt with.
General
38. Supercars may alter these Conditions of Entry and Participation if such changes are reasonably necessary to address safety issues or otherwise protect the legitimate interests of Supercars. Copies of the latest Conditions of Entry and Participation will be available at www.supercars.com.
39. The invalidity or illegality of a provision or any part of a provision in these Conditions of Entry and Participation shall not affect the validity of the remaining provisions of or the valid and legal remainder of such provision of, these Conditions of Entry and Participation.
40. These Conditions of Entry and Participation are governed by the laws applicable in the State of New South Wales and both you and Supercars submit to the jurisdiction of the courts of that state.
